Terms and conditions
GLOSSARY
The words below have the following meanings:
- ‘Consumer’ is an individual who buys goods and services for personal use;
- ‘Customer’ is an individual who buys goods and services from the supplier;
- ‘Contributor’ means anyone who has supplied content or who has been interviewed as part of a project;
- ‘Supplier’ is All Your Own Words;
- ‘Goods’ are the items outlined in a written proposal;
- ‘Proposal’ means a statement of work or quotation describing the goods and services to be provided by All Your Own Words;
- ‘Services’ means the work specified in the proposal;
- ‘Terms and conditions’ mean the terms and conditions set out here and any other terms and conditions agreed in writing by All Your Own Words;
- ‘Contract’ means the legally binding agreement between the customer and All Your Own Words for the supply of goods as outlined in an agreed proposal.
GENERAL
- These terms and conditions apply to all contracts for the supply of goods and services by the supplier (All Your Own Words) to the customer (you). By ordering goods and services you agree to be bound by these terms and conditions.
- These terms and conditions can be varied if agreed in writing by All Your Own Words.
- If you are unhappy with any part of the process or service, please let us know immediately. We will do everything we can to rectify the situation as quickly as possible.
- Nothing in these terms and conditions affects your statutory rights as a consumer.
ORDERS
- Proposals are valid for 30 calendar days.
- You will have accepted a proposal by placing an order in writing (usually by email) with All Your Own Words. ‘Placing an order’ happens when you agree for the works described in a proposal to be carried out. Contractual variations can only be made if agreed by both parties (you and All Your Own Words) in writing.
PRICE AND PAYMENT
- The price is as specified in the proposal and is inclusive of VAT.
- Payment is generally made by bank transfer.
- Payments are generally made in instalments, as outlined in the proposal. We will not start a project until the first instalment is received. The balance must be paid in full before your goods are delivered.
CUSTOMER’S OBLIGATIONS
Our goods and services are bespoke; it is your responsibility to:
- supply all of the agreed documents within the specified timescales, including photographs, family trees and other memorabilia;
- obtain all necessary permissions which may be required;
- provide comments and changes to the work undertaken as described in the proposal. Work will not be completed/printed until we receive your written sign-off (by email). It is your responsibility to ensure the work is accurate;
- All Your Own Words does not fact check information given by you or your contributors. The customer is liable for any damages as a result of complaints made about the content by third-parties.
SUPPLIER’S OBLIGATIONS
- We will ensure that the goods and services, including the process to develop a finished product, correspond to the description outlined in the proposal (unless agreed otherwise by both parties).
- We will do everything we can to make sure a project runs to time and will keep you informed if there is a delay.
- We will ensure that all materials supplied have no defects.
GIFTS
The services supplied by All Your Own Words make fantastic gifts. Where a gift voucher is bought by a customer for someone else, the responsibilities outlined in ‘Customer’s obligations’ move to the contributor, unless otherwise specified in the proposal.
CANCELLATIONS AND REFUNDS
- You can cancel an order by informing us in writing before we have started work on your project. You will not incur a charge. If payment has already been made you will receive a full refund within 14 calendar days.
- You can cancel an order part-way through a project by informing us in writing. Payment will be due for work that has been carried out up to the date of cancellation.
- If a payment has been made in advance, you will be given a refund for the amount overpaid, less any payment for work that has been carried out. Refunds will be made within 14 calendar days.
DELIVERY
- We do everything we can to make sure a project runs to time. However, if any part of the process is delayed by the customer or a contributor, delivery is likely to be delayed too.
- Responsibility for the goods passes to the customer upon delivery. Please check the goods before accepting them.
COPYRIGHT
- Unless agreed in writing, your book or film is private and confidential. We will never publish your story, or any part of it unless we have your explicit written permission.
- Copyright passes to you when the goods have been paid in full. You are then free to publish it should you wish.
UNFORESEEABLE EVENTS
Neither party shall be held liable for failure or delay in the performance of its obligations under these terms and conditions if such performance is delayed or hindered by an unforeseeable act or event which is beyond the reasonable control of either party (‘force majeure’ events).
Unforeseeable events include, but are not limited to war, strikes, accidents, government intervention, or an event described by the legal term act of God (for example, a hurricane, flood or earthquake).
The party affected by a force majeure event shall notify the other as soon as reasonably practicable. Reasonable extensions should be put in place to allow for the work to be completed.
GOVERNING LAW
These terms and conditions, and any dispute, controversy, proceedings or claim of whatever nature arising out of or in any way relating to them, shall be governed by and construed in accordance with English law.
